IDENTIFICATION OF THE LAW:

Decision concerning the approval of the Cooperation between the Romanian Government and the International Organization of Migration, referring to the legal status, to the advantages and possibilities of this organization in Romania.

DESCRIPTION OF LAW CONTENTS:

The Romanian Government allows the organizations to have legal identity and the necessary legal qualities to use its functions. The IOM will have in Romania the same advantages and possibilities that the specialized institutions of the United Nations have according to the Assembly concerning the advantages and the possibilities, from 21st September 1947, and to the law and the changes that Romania has, appropriate to this area.

The representatives of the IOM’s memberships will have in Romania the same advantages and possibilities that the representatives of an organization of the United Nations have, according to the Assembly concerning the advantages and the possibilities, from 21st November 1947 and to the laws to the regulation that Romania has, appropriate to this area.

The manager and the deputy manager of the IOM on the side, and the IOM’s staff on the other will have in Romania the same advantages and possibilities that all the executive leaders and staff from specialized institutions of the United Nations have, according to the Assembly concerning advantages and possibilities, from 21st November 1947 and to the laws and regulations appropriate to this area. The members of the staff considered as being Romanian citizens or those who permanently live in Romania will have the possibility of jurisdiction in what concerns verbal or written statements and all the actions performed by them officially.

The IOM will permanently cooperate with the appropriate authorities from Romania, to ease making justice, to obtain respecting the regulation concerning the public order and to ensure that the staff won’t interfere with Romanian’s internal issues and to prevent and to prevent any abuse.

The IOM will apply in Romania an informative program on migration, cooperating or being assisted by the interest government personalities, which will supply information about the legal procedure of emigration and admition and about the conditions of life in several states which allows emigration and as well about the problems linked to legal emigration. The IOM will also establish programs concerning migration, such as emigrations for local and foreigners, the re-integration of the returned locals, repatriation of the qualified ones, using experts in assisting programs for the countries still developing, selected migration and helpful services.

To accomplish the programs and the activities in Romania, the IOM is authorized by the Romanian Government to open an office in Bucharest and to delegate appropriate local or international staff.

COMMENTS ON THIS DOCUMENT:

The present law offers the legal context of the implementation of several programs on migration by promoting the same advantages and possibilities for the IOM as for others organizations.
