Loi dite “sur la nationalité” 26 juin 1889
La loi indique que seront français les jeunes étrangers nés en France et qui à l’époque de leur majorité sont domiciliés en France à moins d’avoir décliné la nationalité française dans l’année suivant sa majorité (il y a alors nécessité de prouver qu’il a conservé la nationalité de ses parents par une attestation en due forme de son gouvernement…et qu’il n’ait en outre produit, s’il y a lieu, un certificat constatant qu’il a répondu à l’appel sous les drapeaux -Art 4 -).
The law states that those who will be considered as French citizens will be the young foreigners born in France unless they have declined the French nationality within the year after they have reached their majority (there is then the necessity to prove that they retained the nationality of their parents by a certificate in due form from their government… and that they have also produced if necessary a certificate recording that they have responded to the call-up (art 4).
Pour la première fois, le mot nationalité figure dans l’intitulé d’une loi française. L’Etat établit une frontière nette entre nationaux et étrangers.
La défaite de 1871 et la perte de l’Alsace Lorraine, l’esprit de revanche face à l’Allemagne conduisent à renforcer l’évolution amorcée en 1851 (Est français à la naissance tout individu né en France d’un parent qui y est lui-même né (– double droit du sol -).
Les buts étaient démographiques (baisse de la natalité), militaires (il existait un vif ressentiment à l’encontre des jeunes étrangers qui échappaient au service militaire).
Par contre, suivant en cela le Code civil qui assigne aux filles un statut de mineure (subordination de l’épouse au mari), la loi rejette encore de la communauté nationale celles qui épousent un étranger.
For the first time the word “nationality” appears in the title of a French law. The State makes a clear distinction between nationals and foreigners.
The defeat of 1871 and the loss of Alsace Lorraine, the spirit of revenge against Germany led to strengthening the development started in 1851 (is French at birth every person born in France of a parent who was himself born French (double right of soil-).
The goals were demographic ones (falling birth rate), military (there was a strong resentment against the young foreigners who escaped military service).
On the other hand, following the Civil Code, which assigns to girls a status of being a minor (subordination of wife to husband), the law still rejects from the national community those who marry a foreigner.
