Decree requiring the approval of Parliament
The law won a vote of confidence of the Chamber of Commons on the 21 May 2009 and it now has to go to Senate for the ultimate approval
Decree 733/2008 - Provisions on public security
The law comprises 66 articles and it analyzes several issues, but we’ll consider only the ones concerning immigration, i.e. the following:
- unlawful act: ticket and expulsion to punish the illegal stay;
- former Cpt (centres of temporary stay): detention time from 60 days to 6 months;
- acts of civil State: the residence permit is necessary for births and marriages;
- community services: schools and hospitals will open to the immigrants;
- vigilantes: team of volunteers that will help the police force;
- vagrant register: the vagrants will be registered by Municipalities.
It had aroused controversy between the government majority (that supports it) and the minority. Also the Church seems to be worried since the law could injure the integration aim, preventing the familiar reunions and the minors guardianship. According to the opposition, it takes even the risk of “invisible children”, that is of the children who will not be recorded on the register of births by their mothers because they will be threatened by the illegality offence. Moreover the Prime Minister Berlusconi declares that the law complies with the Italian Constitution, to the directives of the European community and to the international law.
