TYPE OF LEGISLATORY ACT:

International Convention among five countries members of the European Union

DATE OF THE PUBLICATION OF THE LAW:

19th June 1990 - Schengen

IDENTIFICATION OF THE LAW:

The Convention is an application of the Schengen agreements taken on 14th June among Belgium, Germany, France, the Netherlands and Luxembourg and concerning the free circulation of people and goods in the countries of the contracting parties.

DESCRIPTION OF LAW CONTENTS:

Definition of foreign citizen: man/woman who is not citizen of one of the member states of the European Community.

Abolition of the systematic controls of the people at the internal borders of the Schengen area.

Strengthening of the controls at the external borders of the Schengen area.

Conditions about foreigners’ circulation (stay, asylum)

Collaboration among police patrols and their possibility to intervene in some cases, even beyond their borders (for instance, during the chase after criminals); request for extradition.

Coordination of the States in their International organized crime fighting (i.e. mafia, arms trade, drugs dealing, illegal immigration).

Integration of police data banks (Schengen Information System, also called SIS)

Transport and circulation of goods

Personal data use.

COMMENTS ON THIS DOCUMENT:

The Convention applies the principles of the goods and people free circulation within the member states and of the internal borders elimination. At the same time it strengthens the crime and illegal stay fighting, setting an alliance of controls and common actions. The negative points are that the immigration laws are not always the same in the various member states and that the lack of controls at the internal borders makes it difficult to check the stay length of a citizen coming from another member country.
